Terms of service

1. Introduction

Welcome to CleanGearHQ, operated by BQU E-Commerce LLC (“CleanGearHQ,” “Company,” “we,” “our,” or “us”).

These Terms of Service govern access to and use of cleangearhq.com, customer accounts, and related services.

By accessing or using our services, you agree to these Terms. If you do not agree, do not use the services.

2. Eligibility

By using the services, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms.

If you use the services on behalf of a company or another legal entity, you represent that you have authority to bind that entity.

3. Accounts and Registration

3.1 Account Creation

You agree to:

  • Provide accurate, current, and complete account information

  • Maintain and update that information when necessary

  • Use the account only for lawful purposes

3.2 Account Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials

  • Activities conducted through your account

  • Promptly notifying CleanGearHQ of suspected unauthorized access

4. Orders and Payments

4.1 Product Availability

Products are subject to supplier availability. CleanGearHQ may limit quantities or discontinue a product.

Availability shown on the website may change before final order acceptance. If an ordered product becomes unavailable, CleanGearHQ will contact the customer and provide the applicable cancellation, alternative, or refund options.

4.2 Pricing

Prices, promotions, and availability may change without notice.

Changes will not affect an accepted order unless CleanGearHQ contacts the customer regarding an obvious pricing, listing, or availability error.

4.3 Payment Terms

CleanGearHQ accepts the payment methods displayed during checkout. Depending on the customer’s device, location, and eligibility, available options may include:

  • Major credit and debit cards

  • Shop Pay

  • PayPal

  • Apple Pay

  • Google Pay

  • Amazon Pay

  • Other methods displayed at checkout

The checkout display controls which methods are currently available for a transaction.

Payments are processed through Shopify and participating payment providers. CleanGearHQ does not receive or store complete payment-card numbers.

The customer agrees to provide accurate billing and payment information. A payment method may be authorized or charged when an order is submitted.

Receiving an order acknowledgment does not guarantee final acceptance, availability, or shipment. If an order cannot be accepted or fulfilled, CleanGearHQ will notify the customer and issue the applicable refund to the original payment method.

4.4 Order Acceptance

CleanGearHQ may refuse or cancel an order because of:

  • Product or supplier availability

  • An incorrect price or product description

  • A payment-authorization problem

  • Incomplete or unverifiable billing or delivery information

  • Suspected fraudulent or unauthorized activity

  • An unsupported delivery location

  • A product-specific or geographic restriction

If CleanGearHQ cancels a paid order, the applicable amount will be refunded to the original payment method.

5. Shipping and Delivery

5.1 Shipping Policy

Shipping destinations, delivery estimates, freight terms, product restrictions, and delivery procedures are explained in our Shipping Policy.

Product-specific delivery information may also appear on the applicable product page.

5.2 Risk of Loss and Delivery Problems

Risk of loss transfers to the customer upon confirmed delivery to the shipping address provided during checkout.

If an order is lost or arrives damaged, contact CleanGearHQ promptly so we can coordinate a carrier investigation and the remedy available under our Shipping Policy and Refund and Return Policy.

This section does not limit any rights available under applicable law.

6. Returns and Refunds

Return eligibility, damage-reporting deadlines, return shipping, restocking fees, brand-specific conditions, and refund processing are explained in our Refund and Return Policy.

7. Intellectual Property Rights

7.1 Ownership

Website content—including text, graphics, logos, images, videos, downloads, and software—is owned by CleanGearHQ, licensed to CleanGearHQ, or provided by suppliers and other content owners.

Content is protected by applicable intellectual-property laws.

7.2 Limited License

CleanGearHQ grants customers a limited, non-exclusive, non-transferable license to access and use the website for lawful personal or internal business purchasing purposes.

7.3 Restrictions

Without applicable authorization, users may not:

  • Reproduce, duplicate, copy, sell, resell, or exploit website content

  • Use CleanGearHQ’s name, branding, or content in a misleading manner

  • Remove intellectual-property or ownership notices

  • Use automated systems to disrupt or improperly extract website content

8. User Content

8.1 Submissions

If you submit a review, photograph, comment, or other content, you grant CleanGearHQ a non-exclusive, royalty-free license to use, reproduce, adapt, and display that content for operating and promoting the business.

You represent that you have the right to provide the content.

8.2 Prohibited Content

Users may not submit content that:

  • Is unlawful, threatening, abusive, defamatory, obscene, or invasive of privacy

  • Infringes intellectual-property or other rights

  • Contains malicious code or deceptive information

  • Misrepresents an identity, relationship, or product experience

9. Prohibited Activities

Users may not:

  • Use the services for an unlawful purpose

  • Interfere with the website, checkout, accounts, servers, or connected networks

  • Attempt unauthorized access

  • Submit fraudulent orders or payment information

  • Misuse product, pricing, or availability information

10. Disclaimers and Warranties

The website and related online services are provided on an “as available” basis to the extent permitted by law.

CleanGearHQ does not guarantee that the website will always be uninterrupted or error-free.

10.2 Product Warranties

Product warranties, when available, are provided according to the applicable product page, manufacturer, or supplier terms.

CleanGearHQ assists with eligible warranty requests but does not independently expand a supplier or manufacturer warranty.

Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.

11. Limitation of Liability

To the maximum extent permitted by law, CleanGearHQ is not liable for indirect, incidental, special, consequential, or punitive damages arising from:

  • Use or inability to use the website

  • Unauthorized access to website systems or personal information

  • Interruptions in online services

  • Misuse, improper installation, or unauthorized modification of a product

These limitations do not apply when prohibited by applicable law.

12. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless BQU E-Commerce LLC, CleanGearHQ, and their personnel from claims arising from:

  • Your unlawful use of the services

  • Your material violation of these Terms

  • Your infringement of another party’s rights

  • Fraudulent or unauthorized activity conducted through your account

13. Suspension and Termination

CleanGearHQ may suspend or terminate access to an account when reasonably necessary because of:

  • A material breach of these Terms

  • Fraudulent or unauthorized activity

  • Misuse of the website or customer account

  • A legal or security requirement

Termination does not eliminate payment or other obligations arising before termination.

14. Governing Law

These Terms are governed by the laws of the State of California and applicable United States federal law, without regard to conflict-of-law principles.

Mandatory rights available under applicable consumer-protection law remain unaffected.

15. Dispute Resolution

If you have a concern regarding an order or these Terms, contact CleanGearHQ first at support@cleangearhq.com or (858) 267-4844 so we can attempt to resolve it informally.

If a dispute cannot be resolved informally, it may be brought before a court of competent jurisdiction as permitted by applicable law.

Nothing in these Terms:

  • Requires a customer to waive rights that cannot lawfully be waived

  • Prevents an eligible claim from being filed in small-claims court

  • Limits remedies available under applicable consumer-protection law

16. Changes to These Terms

CleanGearHQ may update these Terms to reflect changes in the website, products, providers, policies, or business operations.

Changes take effect when posted with a revised effective date.

17. Miscellaneous

17.1 Severability

If a provision is found invalid or unenforceable, the remaining provisions remain in effect.

17.2 Entire Agreement

These Terms and the policies incorporated by reference constitute the agreement between the customer and CleanGearHQ concerning the website and related purchases.

17.3 Waiver

Failure to enforce a provision does not waive the right to enforce it later.
